Welcome to craftsandcollectables.com! 

Crafts and Collectables provides a marketplace where buyers can purchase products or services from local Canadian crafters, cottage industry enthusiasts and businesses (referred to herein as “Vendors”).

You can review the most current version of the Terms of Service at any time on this page. 

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

1.  ACCEPTANCE OF TERMS

By visiting, shopping, acting as a Vendor, or using any other services provided by craftsandcollectables.com (collectively, the “Services”), you are agreeing to be bound by the Terms of Service. 

If you do not agree with the Terms of Service, you cannot use any Services of Crafts and Collectables.

2.  GENERAL TERMS

We reserve the right to refuse service to anyone for any reason at any time.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

The failure of Crafts and Collectables to exercise any rights or enforce any provisions of these Terms of Service shall not constitute a waiver of any such rights or provisions.

A breach or violation of the Terms of Service may result in immediate termination of any Services provided to you, and/or any other action or remedy available to Crafts and Collectables under the law.

3.  VENDOR RESPONSIBILITIES 

Crafts and Collectables is an online marketplace for Canadian Vendors to sell their products. Vendors are independent sellers and their relationship with Crafts and Collectables does not create any agency, partnership, joint venture or employment relationship.

Vendors are responsible for: 

setting prices for products sold through Crafts and Collectables (Vendors may change the prices of products without prior notice)

listing their products for sale (including the accuracy of any images provided of the product)

communicating to the customer the cost of shipping and estimated time for delivery. Please note that Vendors may limit delivery to specific geographic locations, so please ensure you check their shipping policy prior to placing an order

having policies governing exchanges, refunds, or credits and clearly communicating those policies to customers. Please ensure you carefully read a Vendor’s policies governing exchanges, refunds or credits prior to placing your order

dealing directly with the customer to resolve any issues, including processing any exchange, refund, or credit, in accordance with the Vendor’s policies

securely packaging and shipping products directly to the customer

collecting and remitting all federal and provincial taxes, applicable to the sale of goods or services sold by the Vendor

 

4.  LIMITATION OF LIABILITY

Crafts and Collectables does not see or inspect any products sold by Vendors, and we make no representations or warranties of any kind, including express or implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, non-infringement, or safety of, any products sold by Vendors through Crafts and Collectables.  

Crafts and Collectables is not liable for any harm or damages related to the purchase of, or use of products sold by any Vendor.  Any claims relating to a product purchased through craftsandcollectables.com must be made against the Vendor and you release Crafts and Collectables (including its directors, officers and employees) from any such claim. 

5.  INTERRUPTION OR DISCONTINUANCE OF SERVICES

Crafts and Collectables may discontinue or suspend any Services for any user or Vendor, at any time, for any reason. We shall not be liable to you or to any third-party for any costs or damages incurred by you or any third party as a result of any interruption (whether caused by Crafts and Collectables or a third party), suspension or discontinuance of any Services.

6.  PERSONAL INFORMATION

Crafts and Collectables and Vendors who sell products through our site, obtain certain personal information (for example, customer name, address, email) from customers when providing Services. 

Vendors are responsible for protecting and ensuring that any personal information in their custody or under their control is managed and protected in accordance with applicable privacy laws. Crafts and Collectables is not responsible for any unauthorized use or disclosure of personal information by a Vendor.

Crafts and Collectables is responsible for the personal information it obtains when providing Services. Our Privacy Policy sets out more specifically how a customer’s personal information is used and managed by Crafts and Collectables.

7.  ERRORS AND OMISSIONS

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and cancel any orders if any information is inaccurate at any time, without prior notice (including after you have submitted your order).

8.  INDEMNIFICATION

If your actions (including breach of the Terms of Service, misuse of any Services, or infringement of a third party’s rights) result in any claim or demand being made against craftsandcollectables.com, you agree to indemnify, defend and hold harmless Crafts and Collectables, and any of its officers, directors or employees directors, from any such claim or demand.

9.  SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such determination shall not affect the validity and enforceability of any other remaining provisions.

11.  GOVERNING LAW & JURISDICTION

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Alberta, and the laws of Canada applicable therein, without regard to the principles of conflict of laws. Any disputes that may arise between you and craftsandcollectables.com will be submitted to the courts of competent jurisdiction of the Province of Alberta, Canada. 

12.  AMENDMENTS TO TERMS OF SERVICE

We reserve the right to update any part of these Terms of Service or the Additional Terms for Registered Vendors as the case may be, our Privacy Policy, or any other policy referred to in these Terms of Service. Updates will be effective as soon as the changes are posted to these Terms of Service. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
